1. The following terms and conditions are hereby incorporated with and made a part of the Service Contract entered into between the inspector and the client. The client hereby requests the additional inspection services as set forth below. Client understands and agrees that these services are beyond the scope of the services and inspection covered in the Service Contract, and as such agrees to all the following terms, conditions, limitations and exclusions in addition to the terms, conditions and limitations of the Service Contract.

SCOPE OF THE POOL AND/OR SPA INSPECTION The inspection to be performed for the client is a non-invasive physical examination, performed for the additional fee set forth below. This inspection is designed to identify material defects in the following systems and components of the swimming pool and/or spa of the property identified above, as they exist at the time of the inspection. The client agrees that the additional service and inspection covered by this Addendum to Service Contract for Pools and Spas (hereinafter referred to as "Addendum") shall be limited to those specific systems and components that are present and visually accessible, including:

    Mechanical systems including pumps, motors, heaters, filtration components

    Exposed piping, lighting and electrical

    Exposed decking and coping surrounding the pool/spa

    Barrier fencing, installed door alarms and gates

The inspection report shall describe and identify the inspected systems and components of the pool/spa and shall identify material defects in those systems and components observed during the inspection.

The inspector's agreement in this Addendum to increase the scope of service and inspection contained in the Service Contract shall not be deemed a waiver or an increase of any legal or contractual duty or obligation of the inspector as to any other provision, term, condition or limitation contained in the Service Contract.

LIMITATIONS, EXCEPTIONS AND EXCLUSIONS The client agrees that this agreement does not cover or extend to any system, structure, or component of the pool and/or spa which is inaccessible, concealed from view, cannot be inspected due to circumstances beyond the control of inspector, or client has agreed is not to be inspected. Further, the client agrees that all swimming pools and hot tubs to be inspected must be full of water, clean and operational for the inspector to perform an inspection, and any heating systems or elements must be turned on at least twenty-four (24) hours prior to the inspection. Unless specifically agreed otherwise between the inspector and client, the client agrees the following items are excluded from the inspection:

Pool body and decorative components such as tile, paint, and special coatings

All underground piping and electrical

Operation of directional handles or valves

Leak detection of non-visible plumbing

Chemical and water treatment systems, including the chemical conditions of the water in the pool/spa

Sizing, adequacy and projections of life expectancy or future performance of any equipment, system, structure or component

Operation of electronic pool equipment/panels/remote controls

Determining compliance with installation guidelines, manufacturer’s specifications, building codes, ordinances, regulations, covenants, or

other restrictions, including local interpretations there of

All other limitations, exceptions and exclusions as set forth in the Service Contract

The client agrees that a pool/spa may have inherent defects that are NOT visible at the time of the inspection and that items indicated as "Deficient/Deficiency" should be further evaluated by a licensed/certified pool/spa specialist.

The client acknowledges and agrees that he/she has read and understood all the terms, conditions and limitations of this Addendum and voluntarily agrees to be bound hereby for the additional fee listed below. This agreement shall be construed and enforced in accordance with the laws of the State of Texas, with venue for any and all claims and causes of action to be in Bexar County.
